WILLS A will is a legal document that dictates a person’s final wishes for distribution of his or her personal property and money after death. A will is the most basic estate planning tool. A trust can be used in conjunction with a will to ensure that your wishes and your family are taken care of after you are gone. We can tailor a plan to your specific needs and wishes. A will allows you to name an executor for your estate and to distribute your assets to your listed beneficiaries. If you die without a will, then the State of California will decide for your estate who receives what assets determined through the laws of intestacy. It is important to remember that whether you die with or without a will, your estate will have to go through the California Probate process which is inevitably an expensive and time-consuming process. An estate that goes through the probate process will be subject to costly statutory probate fees for both attorneys and executors. There is a common misconception that having a will avoids this process, but this is simply not the case. Most people in California need a revocable trust instead of a will. Even if you own very little, a will simply ensures that some attorney will make more money from you than if you had prepared a revocable living trust. This is because if you own more than $20,000 worth of real estate, your estate must go through probate. Or, if you own no real estate but have $100,000 or more of other assets (bank accounts, investments, etc.), your estate must go through probate.
